Terms & Conditions – Peace Haven on Lagoon

Effective Date: March 2026

1. Legal Framework

These Terms are governed by the laws of South Africa, including the:

Consumer Protection Act (CPA)
Protection of Personal Information Act (POPIA)

By making a booking, you confirm that you have read and accepted these Terms.

2. Booking Contract

A legally binding agreement is formed when:

A booking is made; and
Payment (deposit or full amount) is received

We reserve the right to decline bookings at our discretion.

3. Pricing & Transparency (CPA Compliance)

All prices displayed:

Are in South African Rand (ZAR)
Include applicable taxes unless stated otherwise
Are subject to change prior to booking confirmation

No hidden fees will be charged without disclosure.

4. Payment Terms
A deposit is required to secure your booking
Full payment must be made before arrival (unless otherwise agreed)
Failure to pay may result in cancellation
5. Cancellations (CPA Alignment)

In accordance with the CPA:

Cancellation fees are reasonable and based on timing and losses incurred
Guests are informed of cancellation terms upfront

6. Occupancy & Use of Property
Maximum occupancy: 8 guests
The property is rented as a whole unit
No unauthorised guests or events allowed

Violation may result in immediate termination without refund.

7. Security Deposit & Damages

Guests are responsible for:

Damage to property
Loss of items
Excessive cleaning

Costs may be deducted from a security deposit or invoiced.

8. Guest Conduct

Guests must:

Respect neighbours and local laws
Avoid excessive noise
Use facilities responsibly

Failure to comply may result in eviction.

9. Limitation of Liability (IMPORTANT – CPA SAFE WORDING)

To the fullest extent permitted by law:

We are not liable for indirect or consequential damages
We are not responsible for loss of personal belongings
Use of the property is at the guest’s own risk

Nothing in this clause excludes liability where it is unlawful to do so under the CPA.

10. Force Majeure

We are not liable for failure to perform due to events beyond our control, including:

Weather conditions
Loadshedding
Government restrictions
Natural disasters
11. Health & Safety

Guests acknowledge:

The presence of potential hazards (e.g., pool, stairs, braai areas)
Responsibility for supervising children
12. Third-Party Platforms

Bookings made through platforms like Airbnb or Booking.com are subject to their respective terms.

13. Amendments

We may update these Terms at any time. Continued use constitutes acceptance.

These policies are designed to comply with South African consumer and data protection laws, including POPIA and the CPA.
